RehabKit — Terms of Service
These Terms of Service (“Terms”) govern your use of RehabKit and its associated widgets and Live Activities (together, the “App”), provided by Schumacher PT & Performance LLC. By using the App you agree to these Terms.
Not a Medical Device
RehabKit is a clinical support and reference tool. It provides exercise timers, measurement and movement-analysis aids, calculators, research feeds, and clinical reference material. It is not a medical device, does not diagnose, treat, or prescribe, and is not a substitute for the professional judgment of a qualified healthcare provider. See the Medical Disclaimer.
Professional Responsibility
If you use the App in a professional or clinical setting, you are solely responsible for your clinical decisions, for obtaining any patient consent required (including to record video), and for complying with the laws, regulations, and professional standards that apply to you.
HIPAA and Protected Health Information
RehabKit is designed to minimize collection of personal information: it does not require an account, collect patient names or contacts, or intentionally collect medical information. However, RehabKit is not offered as a HIPAA-compliant electronic health record, patient portal, or protected health information system, and we do not enter into Business Associate Agreements. Do not put protected health information into playlist names, notes, videos, photos, or shared content if your use requires HIPAA-regulated handling.
Assumption of Risk
Physical exercise and testing carry an inherent risk of injury. You acknowledge that risk and agree that the decision to perform any exercise, test, or measurement is yours (and, where applicable, your patient’s) and that you are responsible for ensuring it is appropriate.
Your Content
When you record or import a video or photo, that content is yours. We do not claim any ownership or license to it: it is stored on your device in encrypted form, and we never receive it unless you choose to share it. You are responsible for having the right to record, store, and share any content you add.
Third-Party Content
The App includes links to, and displays content from, third parties, including journal articles, clinical practice guidelines, and clinical prediction rules. That content is owned by its respective publishers and authors, remains subject to their terms, and is provided for reference. We do not endorse, and are not responsible for, third-party content. AI-generated summaries of guidelines and articles may be incomplete or inaccurate and are not a substitute for the source material.
Prohibited Conduct
You agree not to:
- Reverse engineer, decompile, or disassemble the App, except to the extent permitted by applicable law.
- Circumvent or attempt to circumvent the App’s trial limits, subscription checks, or purchase validation.
- Redistribute the clinical reference content included in the App.
- Introduce malware, or attempt to interfere with the App’s normal operation.
- Use the App in a way that infringes anyone else’s intellectual property or privacy rights.
Intellectual Property
The App — including its software, design, icons, sounds, and the “RehabKit” name and logo — is owned by Schumacher PT & Performance LLC and protected by copyright, trademark, and other intellectual-property laws. Subject to these Terms and Apple’s Standard End User License Agreement, you receive a limited, personal, non-transferable license to use the App.
Subscriptions & Purchases
RehabKit includes a free trial and offers monthly, annual, and lifetime purchase options that unlock the full App. These are billed and managed through your Apple Account under Apple’s Standard End User License Agreement and App Store terms, including Apple’s renewal and cancellation rules.
Third-Party Services
The App relies on third-party services to work, including Apple (StoreKit and CloudKit), OneSignal (push notifications), and RevenueCat (purchase validation). Your use of those services is governed by their own terms and privacy policies.
No Warranty
THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT ANY MEASUREMENT, CALCULATION, OR CONTENT IS ACCURATE OR COMPLETE.
Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, SCHUMACHER PT & PERFORMANCE LLC AND ITS OFFICERS, EMPLOYEES, AND CONTRACTORS WILL NOT BE LIABLE FOR ANY INJURY OR OTHER LOSS ARISING FROM OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE APP, INCLUDING CLINICAL DECISIONS MADE WITH THE HELP OF THE APP.
Changes to These Terms
We may update these Terms as the App changes. Material changes will be reflected by updating the effective date above. Continued use of the App after an update constitutes acceptance of the revised Terms.
